Last updated: October 12, 2026

These Terms of Service ("Terms") govern your access to and use of the websites, cloud services and software provided by Cobaltmere, LLC, a Delaware limited liability company ("Cobaltmere", "we", "us"). By creating an account, purchasing a subscription or using our services, you agree to these Terms. If you use the services on behalf of an organization, you agree to these Terms on its behalf.

1. The services

Cobaltmere provides Hourmere, scheduling and appointment booking software offered as (a) an open-source edition that you may download and self-host, and (b) a hosted cloud service ("Cloud Service"). The open-source edition is licensed under the license that accompanies its source code, and that license, not these Terms, governs your use of the self-hosted software.

2. Accounts

You must provide accurate information when creating an account and keep your credentials secure. You are responsible for activity under your account and for the accounts of users you invite. You must be at least 16 years old to use the Cloud Service.

3. Subscriptions and payment

4. Acceptable use

You agree not to: use the services for unlawful, fraudulent or abusive purposes; send spam or unsolicited communications through booking notifications; attempt to gain unauthorized access to the services or other users' data; interfere with or overload the services; or resell the Cloud Service without our written permission. We may suspend accounts that violate these rules.

5. Your data

You retain all rights to the data you and your invitees submit to the Cloud Service ("Customer Data"). You grant us a limited license to host, process and transmit Customer Data solely to provide and improve the services. Our handling of personal data is described in our Privacy Policy. You may export or delete your data at any time; we delete Customer Data within 30 days after account deletion, except where retention is required by law.

6. Third-party services

The services integrate with third-party services such as Google Calendar, Microsoft 365, Zoom and AI assistants. Your use of those services is governed by their own terms, and we are not responsible for them.

7. Availability and changes

We work to keep the Cloud Service available but do not guarantee uninterrupted operation. We may modify or discontinue features. If we discontinue the Cloud Service, we will give at least 60 days' notice and a way to export your data.

8. Disclaimers

The services are provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement, to the maximum extent permitted by law.

9. Limitation of liability

To the maximum extent permitted by law, Cobaltmere will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim relating to the services will not exceed the amount you paid us in the 12 months before the event giving rise to the claim.

10. Termination

You may stop using the services and cancel your subscription at any time. We may suspend or terminate your access if you materially breach these Terms. Sections that by their nature should survive termination will survive.

11. Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law rules. Nothing in these Terms limits any rights you have under mandatory consumer protection laws of your country of residence.

12. Changes to these Terms

We may update these Terms. If changes are material, we will notify you by email or in the product at least 30 days before they take effect.
